Current hourly rates for services
- Engineer: 125.00 euros/hour
- Technician: 75.00 euros/hour
The hourly rates listed are net plus the currently applicable value added tax.
For projects that take a longer period of time, monthly interim invoices will be issued. Otherwise, invoicing will take place after completion of the project.
Remuneration is payable in accordance with the payment terms printed on the invoice.
Travel time is also charged at the hourly rates listed above.
Services provided on Saturdays, Sundays, and public holidays are charged at a surcharge of 50% on Saturdays and 100% on Sundays and public holidays on top of the respective hourly rate.
Travel expenses
Mileage allowance for travel by car
km 0.75 Euro
Calculations are based on the location of ProCon automatic systems GmbH, Mücke.
Travel abroad will be invoiced separately according to actual costs incurred.
Travel expense reimbursement
The applicable flat rates for travel expenses in Germany and abroad, as recognized by the tax office, will be charged.
Accommodation costs
The actual costs incurred for upscale hotels will be billed with receipts or paid directly by the customer.
Other travel expenses
Any travel expenses incurred that are not included in the services listed above will be invoiced according to receipts or paid directly by the customer.
Work results
All written and machine-readable work results created directly for the customer belong to the customer, subject to the following provisions.
Ideas, concepts, knowledge, and techniques based on the experience of ProCon automatic systems GmbH will not be handed over to the customer in written form.
This order does not prevent ProCon automatic systems GmbH from developing work results that are similar or comparable to those handed over to the customer.
Estimates, projections
Quotations and cost estimates are non-binding. The fees to be invoiced to the customer are based on the final scope of the services rendered.
We can only provide a final calculation of the time required after a comprehensive project discussion and a precise definition of the scope of work.
A binding specification sheet must be provided by the customer after the final project meeting with ProCon automatic systems GmbH. If the specification sheet is created by ProCon automatic systems GmbH, the work involved will be invoiced to the customer separately.
Type of activity
ProCon automatic systems GmbH supports its customers in the project planning, program creation, and commissioning of machines and systems.
ProCon automatic systems GmbH provides the customer with personnel for services to the extent specified in the order confirmation. ProCon automatic systems GmbH can provide the services at the customer's premises or at its own business premises. Third parties may be called upon to perform the services.
The customer remains responsible for the activities to be performed. ProCon automatic systems GmbH does not assume any warranty or liability for the result.
Liability
ProCon automatic systems GmbH assumes liability for direct personal injury and property damage incurred by the customer as a result of gross negligence on the part of ProCon automatic systems GmbH.
ProCon automatic systems GmbH is not liable for the loss of recorded data.
Liability for lost profits, for damages arising from third-party claims against the customer, and for other consequential damages is excluded, as is liability for damages arising from support and advice provided by ProCon automatic systems GmbH, unless ProCon automatic systems GmbH & Co.KG is responsible for a grossly negligent breach of contractual obligations.
The liability of ProCon automatic systems GmbH is limited to 50% of the order value, except in cases of gross negligence.
General provisions
This contract contains all agreements relating to the subject matter of the contract.
Any deviating agreements and arrangements must be made in writing to be legally valid. Additions and amendments must be expressly identified as such and signed by both parties.
Should individual agreements made in this contract be invalid, this shall not affect the validity of the rest of the contract.
The place of jurisdiction for all disputes arising from this contract is the officially competent area where ProCon automatic systems GmbH & Co.KG has its registered office in Mücke.
